Yeah, it is unlikely that they will be able to prosecute all the uploaders and viewers of copyrighted material in this case. However, they can try to hit a handful of people very hard to make a public example of them. I doubt that will deter all users. It will give them something to think about though.
I recommend creating a buffer overflow on Viacom's servers...
Anyways, it turn out like ryuuk said with the whole making an example thing. But seriously if this is over clips and not full videos they need to cool off and do their job and not complain... I'll probably end up switching my NIC and burn it or change my MAC address:p. Yep take that Viacom.XD

That just really pisses me off for many reasons. It is against the law to do so and the judge pretty much made an illegal rule. The DMCA clearly states that website owners are not responsible for what users upload.

They are responsible for taking videos against rules down, still..they aren't responsible for videos being uploaded seeing as the rules state what you are or aren't supposed to upload. For example, someone posted a porn video against rules and youtube decided to finally take it down but someone is sueing them because "porn" was on youtube. The one rule "We aren't responsible for what users may put on there" basically just rips through that whole argument and the rule "No porn" gets rid of the video anyways.
If it states they have no responsibility for what is put up then they don't. But they still have rules to make youtube a safe place besides "porn" or basically something very bad.
This is stupid, they can't do that. Just because someone is watching something that is copyrighted online, doesn't mean they ment to watch it, they can't use it as evidence. To be perfectly honest companies should do more to stop their materials getting onto the web in the first place.
And they can't hand over personal information, it's illegal, they are bound by a legal obligation that you agree to when signing up to the website that they will not hand over any personal information to a third party source. Basically it's illegal. Defiantly under UK law anyway, and US isn't that different. In my expiriance US law is more lenient in these situations, look what happened with TV links.
